Fiktionsbescheinigung in Berlin: Travel, Work and Extension Guide

If your German residence permit is close to expiring while Berlin is still processing your extension or new residence application, you may come across the word Fiktionsbescheinigung.
This document is easy to misunderstand. It is not a new residence permit by itself, and the rights it documents are not the same in every case.
For newcomers in Berlin, the most important distinction is whether the certificate is issued under § 81(4) or § 81(3) of the German Residence Act. That difference can affect whether you may continue working and whether you can leave Germany and return.

What is a Fiktionsbescheinigung?
A Fiktionsbescheinigung is a certificate used by the immigration authority when a decision on an application for a residence title cannot yet be completed.
Berlin's official Fiktionsbescheinigung service gives examples such as:
- required documents are still missing;
- the immigration file is not yet available;
- a new electronic residence permit cannot be handed over before the current permit expires; or
- another proceeding must be completed before the LEA can decide.
A key point is that a residence-title application must already exist. Berlin does not describe the Fiktionsbescheinigung as a substitute for applying for your residence permit or extension.
Do you get one automatically when your residence permit expires?
No.
Berlin says a Fiktionsbescheinigung can only be issued when:
- you have already applied for the issue or extension of a residence title;
- your stay was still lawful at the relevant time; and
- the LEA cannot yet make the final decision when your case is handled.
Do not simply wait for your existing card to expire and assume a Fiktionsbescheinigung will automatically appear.
If your residence title has an expiry date approaching, follow the official application route for your actual residence category in good time.
The most important difference: § 81(4) versus § 81(3)
The words printed on your certificate matter.
Berlin's official guidance distinguishes two common situations.
Fiktionsbescheinigung under § 81(4)
Berlin says § 81(4) applies when you had a currently valid residence title, such as an Aufenthaltserlaubnis or a national long-stay visa (category D), when the relevant application was made.
In this situation, Berlin states that the existing residence title continues to apply together with its supplementary conditions until the application is decided.
That includes existing conditions concerning employment.
Berlin also states that travel abroad and re-entry into Germany are possible with a valid Fiktionsbescheinigung under § 81(4).
This is the version many people mean when they talk about their old residence rights "continuing" while an extension is pending.
Fiktionsbescheinigung under § 81(3)
Berlin says § 81(3) can apply when a person is lawfully in Germany without a visa because their nationality permits visa-free residence, and they apply for a residence title while that lawful stay still exists.
Berlin states that this certificate allows the person to remain in Germany until the application is decided.
However, Berlin explicitly says a § 81(3) Fiktionsbescheinigung:
- does not permit re-entry into Germany after leaving; and
- does not permit starting gainful employment.
That makes it very different from a § 81(4) certificate.
Can you travel with a Fiktionsbescheinigung?
It depends on the legal basis shown on your certificate.
According to Berlin's current guidance:
- a valid § 81(4) Fiktionsbescheinigung allows travel abroad and re-entry into Germany;
- a § 81(3) Fiktionsbescheinigung does not authorize re-entry into Germany.
Do not treat the general word "Fiktionsbescheinigung" as enough to answer a travel question.
Check the legal paragraph printed on your own document.
You should also remember that Germany's re-entry rule does not automatically answer every question about:
- entry requirements of your destination country;
- transit through another country;
- airline document checks; or
- passports that are close to expiry.
If an international trip is important or difficult to change, verify the rules for your specific document and route before leaving Germany.
Can you continue working?
Again, the legal basis matters.
For a § 81(4) certificate, Berlin states that the previous residence title continues with its supplementary conditions, including employment conditions.
That means the employment permission attached to the previous title is relevant while the legal continuation applies.
By contrast, Berlin explicitly states that a § 81(3) Fiktionsbescheinigung does not permit the commencement of gainful employment.
Do not rely on a generic internet answer if your job depends on the distinction. Check the wording of your existing title, Zusatzblatt and Fiktionsbescheinigung, and seek qualified advice if the employment situation is unclear.
Can a Schengen visitor get a Fiktionsbescheinigung?
Berlin's current service page says a Fiktionsbescheinigung cannot be issued to holders of a Schengen visa for a short stay, category C.
That is different from a national category-D visa used for longer stays.
If you are in Germany on a short-stay Schengen visa, do not assume the Fiktionsbescheinigung procedure is available simply because your visa is close to expiring.
What do you need in Berlin?
Berlin currently lists the following core requirements for the Fiktionsbescheinigung service:
- lawful residence at the relevant time;
- an existing application for a residence title or extension;
- Hauptwohnsitz in Berlin; and
- personal attendance.
The listed documents include:
- a valid passport or passport substitute;
- your previous residence title, if available; and
- proof of your Berlin main residence.
For address evidence, Berlin currently lists either a registration confirmation (Meldebestätigung) or the combination of a tenancy agreement and landlord move-in confirmation.
A Fiktionsbescheinigung is only valid together with a valid passport or passport substitute.
Does the LEA issue it online?
Berlin currently lists personal attendance as required for issuing the Fiktionsbescheinigung.
The certificate is normally issued when you attend and the authority can confirm the requirements.
However, the route for obtaining LEA appointments has changed over time. Berlin has retired its old general Online-Terminvereinbarung system and increasingly uses residence-title online applications or the responsible department's contact process before appointments are assigned.
Do not buy an appointment from a third party or rely on an old guide that tells you to refresh the former OTV appointment calendar.
Use the current official service page and the instructions for your underlying residence application.
How much does a Fiktionsbescheinigung cost in Berlin?
Berlin currently lists:
- €13.00 for adults; and
- €6.50 for minors.
Berlin also lists several fee exemptions, including certain protected-status groups, Turkish citizens in the circumstances covered by the service rules, recipients of qualifying public scholarships, and people who provide current evidence of specified social-benefit receipt.
Because exemptions depend on the individual case, check the live official page before your appointment rather than assuming the normal fee always applies.
How long does issuance take?
Berlin's ServicePortal currently says the Fiktionsbescheinigung is issued at the personal appointment.
That does not mean the waiting time for the underlying residence application or for an LEA appointment is immediate.
The residence application itself can remain pending while the Fiktionsbescheinigung documents the relevant interim status.
What if your residence card expires before the LEA appointment?
The important administrative step is making the correct residence-title application in time, not simply possessing an appointment date.
A Fiktionsbescheinigung is used to document an interim legal situation when the LEA cannot yet decide the residence application.
Keep evidence of your application submission and LEA correspondence.
If you specifically need proof for an employer, a planned journey or another authority, use the official LEA contact route for your residence category and explain what proof you need.

Is an application confirmation the same as a Fiktionsbescheinigung?
No.
A submission confirmation can be useful evidence that you sent an application, but it is not automatically the same document as a Fiktionsbescheinigung.
For questions involving work, travel or re-entry, do not assume that a screenshot, automated email or appointment confirmation gives you the same rights as a valid certificate issued under a particular subsection of § 81.
Check the actual document and official LEA instructions.
What if you already received your new eAT approval?
A Fiktionsbescheinigung can still be relevant when the LEA has ordered a new electronic residence permit but the physical card cannot be handed over before the old title expires.
Berlin specifically lists delayed eAT handover as one of the situations in which the certificate may be used.
Once you receive the new residence permit, use the new document and keep old interim paperwork for your records where appropriate.
Common mistakes to avoid
Assuming every Fiktionsbescheinigung allows travel
It does not. Berlin clearly distinguishes § 81(4) from § 81(3).
Leaving Germany with a § 81(3) certificate
Berlin says this version does not authorize re-entry into Germany.
Assuming the document creates a residence application
Berlin requires an underlying application for the residence title or extension first.
Treating an application email as the certificate
A submission receipt and a Fiktionsbescheinigung are different things.
Forgetting the passport
Berlin says the certificate is valid only together with a valid passport or passport substitute.
Using old appointment-booking advice
The former general LEA online appointment system has been permanently retired. Follow the current online-application or contact instructions instead.
Assuming your old work conditions changed automatically
For § 81(4), Berlin says the existing title continues with its supplementary conditions. Read the conditions on your own documents rather than assuming broader work permission.
Checklist if your residence permit is expiring
- I checked the expiry date on my current residence title.
- I submitted the correct residence-title or extension application through the current official route.
- I saved evidence of the submission and LEA correspondence.
- My passport or passport substitute is still valid.
- I have my previous residence permit and Zusatzblatt, if applicable.
- I have proof of my Berlin Hauptwohnsitz.
- If I received a Fiktionsbescheinigung, I checked whether it states § 81(3) or § 81(4).
- I did not assume travel permission without checking the specific certificate.
- I checked my employment conditions before relying on the certificate for work.
- I checked the current official LEA appointment/contact instructions instead of using an old appointment-booking guide.

A Fiktionsbescheinigung is not one uniform "temporary visa."
